My "guess" on the subject:  I think they are considering a case of a satellite 
airport *under* the Class-C.

For example, Austin Executive (for the couple of months life it has left) is 
under but not *in* the Robert Muellar (Austin) class-C (for the three months 
of life *it* has left).  I can takeoff and land at Exec all day long, without 
talking to a sole.  But, unless otherwise specifically authorized, I must have 
Mode C on and functioning.
