In that case, doesn't .04 seem (at best) arbitrary and (at worst)
dangerous?

What do you imagine is the reason .04 was selected?

Quite unfortunately, that portion of the brain that produces
common sense isn't included in everyone's head.

I personally do it the same way you do it. I generally don't
drink more than one or two beers the night before I'm flying,
but I'm far more concerned with evaluating my ability to fly
than I am with pushing myself to fly just because I might be
within the letter of the law.
